Do you need your Queensland Driver’s Licence for work?

Demerit Point Accumulation

If you exceed the amount of allowable demerit points Queensland Transport will send you a letter asking you to choose whether:-


1. Your Driver’s Licence be suspended for a period of 6 months; or,

2. You enter a Good Driver Behavior Period in which you will be allowed one demerit point for a period of 12 months.

If you get more than one demerit point during the Good Driver Behavior Period your Driver’s Licence will be suspended.  If this happens, you can appeal against the suspension on the basis that you require your Driver’s Licence for work and will suffer severe financial hardship as a result of any suspension.
You will also have to prove to the Court that you are a fit and proper person to hold a Driver’s Licence.

 

Drink Driving Disqualification

If you are convicted of drink driving you will lose your Driver’s Licence unless you make an application for a Restricted Work Licence.  You must satisfy certain criteria before you will be eligible to make the application. 

If this criteria is satisfied you must give evidence to the Court showing:-

1. Your need for a Driver’s Licence;

2. 
Your financial hardship if you were to lose your Driver’s Licence; and

3. You are a fit and proper person to hold a Driver’s Licence.

Even if you do not wish to apply for a Restricted Work Licence it is important that you seek legal advice and have representation in Court to protect yourself by limiting the amount of the fine and period of disqualification for which you will be liable.

The Queensland Government has increased penalties for many traffic offences, particularly those involving drinking and excessive speed.  Anti-hoon legislation has also been introduced which can have a serious impact on your ability to hold a Driver’s Licence.
